By downloading, installing, accessing, or using the Growthh mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User" or "you") and Gyaanmart Knowledge Technology Pvt Ltd ("Company," "we," "us," or "our"), the developer and operator of Growthh.

2. Service Description

Growthh is a business workflow automation application designed to help small and medium enterprises (SMEs) streamline their operations through:

• Automated task assignment and management
• Real-time dashboard and performance analytics
• WhatsApp and email reminder systems
• Recurring task automation
• Visual workflow mapping
• Centralized file storage and management

The App is designed for teams ranging from 2 to 200 members and requires iOS 15 or above for optimal performance.

3. Eligibility and Account Registration

3.1 Eligibility Requirements

To use Growthh, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding agreements
• Represent a legitimate business entity
• Have a compatible iOS device (iOS 15+)

3.2 Account Registration

You must create a secure account with accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Promptly notifying us of any unauthorized use
• Ensuring your account information remains current and accurate

4. Acceptable Use Policy

You may use Growthh only for lawful business purposes in accordance with these Terms and applicable laws.

You agree not to:

5. User Content and Data

You retain ownership of all content, data, and information you upload to Growthh ("User Content"). By using the App, you grant us a limited, non-exclusive license to process your User Content solely for the purpose of providing our services.

You are solely responsible for your User Content and warrant that:

• Your content does not violate any third-party rights
• Your content complies with applicable laws and regulations
• Your content does not contain malicious code or harmful materials

5.3 Data Backup and Security

While we implement security measures to protect your data, you are responsible for maintaining your own backups of critical business information.

6. Subscription and Payment Terms

6.1 Subscription Model

Growthh operates on a subscription-based model. No free trial is currently available, and a registered account is required to access the platform.

6.2 Payment Terms

• Subscription fees are charged in advance on a recurring basis
• All fees are non-refundable unless otherwise stated
• You authorize us to charge your selected payment method
• Failed payments may result in service suspension

6.3 Price Changes

We reserve the right to modify subscription prices with 30 days' advance notice to existing subscribers.

7. Intellectual Property Rights

All intellectual property rights in Growthh, including but not limited to:

• Software code and algorithms
• User interface design and graphics
• Trademarks and brand elements
• Documentation and training materials

Are owned exclusively by Gyaanmart Knowledge Technology Pvt Ltd.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use Growthh solely for your internal business purposes during your subscription period.

8. Privacy and Data Protection

Your privacy is important to us. Our data collection, use, and protection practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference.

8.1 Data Processing

We process your data solely to provide and improve our services, including:

• Account management and authentication
• Task automation and workflow management
• Performance analytics and reporting
• Customer support and communication

8.2 Data Security

We implement industry-standard security measures, including encryption in transit and at rest, to protect your information.

9. Service Availability and Support

9.1 Service Level

While we strive to maintain high availability, we do not guarantee uninterrupted service. Scheduled maintenance and updates may temporarily affect service availability.

9.3 System Requirements

You are responsible for ensuring your devices meet the minimum system requirements (iOS 15+) for optimal App performance.

10. Limitation of Liability

10.1 Disclaimer of Warranties

Growthh is provided "as is" without warranties of any kind, either express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

10.2 Limitation of Damages

To the maximum extent permitted by law, Gyaanmart Knowledge Technology Pvt Ltd shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from third-party service interruptions
• User error or misuse of the application

Our total liability shall not exceed the amount paid by you for the service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Gyaanmart Knowledge Technology Pvt Ltd from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your misuse of the App
• Your User Content or data
• Your violation of applicable laws

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting our support team. Termination does not entitle you to a refund of prepaid fees.

12.2 Termination by Us

We may suspend or terminate your account immediately if you:

• Violate these Terms
• Fail to pay subscription fees
• Engage in harmful or illegal activities
• Attempt to circumvent our security measures

12.3 Effect of Termination

Upon termination, your access to the App will cease, and we may delete your data after a reasonable retention period for backup purposes.

13. Modifications to Terms
